NEWPORT — In an affidavit filed in the Criminal Division of Orleans County Superior Court, Newport City Police Detective James LeClair said he along with fellow Newport officers Sergeant Nicholas Rivers, and Patrolmen Joshua Lillis and Tanner Jacobs, were called to a home on Short Spring Street to investigate a call. The caller, who reached the police just before 8 a.m. on March 24, said his downstairs neighbor Matthew Payne, 51, of Derby, had fired a handgun and had a woman by the throat, the affidavit says.
When Detective LeClair arrived, he said, Patrolmen Lillis and Jacobs were already there next to the garage with the woman. Detective LeClair said all three were taking shelter because Mr. Payne still had the handgun.
